Gasthaus Edelweiss-Backpackers Generos-Bodhi Camping
Geltungsbereich/Field of application
Diese AGB finden auf sämtliche Rechtsbeziehungen zwischen dem Gasthaus Edelweiss - Backpackers Generoso - Bodhi Camping (nachstehend Gasthaus Edelweiss genannt) und dem Gast Anwendung.
These terms and conditions apply to all legal relationships between the Gasthaus Edelweiss - Backpackers Generoso - Bodhi Camping (Gasthaus Edelweiss) and the guests.
1. Vertragsabschluss/Contract closing
Mit der Entgegennahme der schriftlichen, telefonischen, elektronischen oder persönlichen Buchung und der Zustellung unserer Bestätigung kommt ein Vertrag zwischen dem Gast und dem Gasthaus Edelweiss zustande. Die vorliegenden allgemeinen Vertragsbedingungen sind Bestandteil dieses Vertrages. Mitteilungen per Email gelten als schriftlich erfolgt.
With the acceptance of the writing, by telephone, electronic or personal booking and the delivery of our confirmation, a contract between the guest and the Gasthaus Edelweiss comes in action. The presented general conditions are part of this contract. Releases via email is considered as written confirmation.
2. Buchungsbedingungen/Bookings
Für alle Buchungen müssen als 50% als Anzahlung erfolgen, oder uns die Kreditkarten-Details bekannt gegeben werden. Werden diese Bedingungen nicht eingehalten, kann das Gasthaus Edelweiss die Buchung ohne Benachrichtigung annullieren. Für die Annullationskosten gilt Ziff. 4 nachfolgend.
For all bookings a deposit of 50% or credit card details announced us. If these conditions are not complied with, the Gasthaus Edelweiss can cancel the reservation without notice. For the cancellation clause 4 applies below.
3. Preisänderungen/Price changes
In den folgenden Fällen kann das Gasthaus Edelweiss die ausgeschriebenen Preise ändern:
neu eingeführte oder erhöhte staatliche Abgaben (z. B. Mehrwertsteuer, Kurtaxen u.s.w.)
eindeutig erklärbare Druckfehler
In the following cases, the advertised rates can be changed by the Gasthaus Edelweiss: new or increased state taxes (. Eg VAT, taxes u.s.w.) clearly explainable misprints.
4. Annullationen und Umbuchungen/Annullation and booking changing
4.1 Allgemeine Bedingungen/General terms and conditions
Annullationen oder Umbuchungen sind nur gültig, wenn diese schriftlich an das Gasthaus Edelweiss zugestellt werden.
Cancellations or changes are only valid if they are sent in writing to the Gasthaus Edelweiss.

Änderungen/Annullationen bis 14 Tage vor Anreise: bereits geleistete Anzahlung wird in Form eines Gutscheines rückvergütet
Changes / cancellations until 14 days before arrival: your deposit will be refunded in the form of a voucher.
Änderungen/Annullationen vom 14. bis und mit 7. Tag vor Ankunft: 50% des gebuchten Arrangement bleiben geschuldet.
Changes/cancellations from 14 to and with 7 days prior to arrival: 50% of the booked arrangement will remain owed to the Gasthaus Edelweiss,
Änderungen/Annullationen vom 6. bis und mit 0. Tag vor Ankunft: 100% des gebuchten Arrangement bleiben geschuldet.
Changes/cancellations from 6 to and with arrival day: 100% of the booked arrangement will remain owed to the Gasthaus Edelweiss.
4.2 Annullationsdatum und Versicherung/Annullation date and insurance
Massgebend zur Berechnung des Annullationsdatums ist das Eintreffen der schriftlichen Erklärung bei der Buchungsstelle. An Samstagen, Sonn- und Feiertagen ist der nächste Werktag massgebend.
Die Annullierungskosten werden in Härtefällen von einer Annullierungskostenversicherung übernommen, sofern der Gast eine solche abgeschlossen hat.

4.3 Stellen einer Ersatzperson/Substitutes
Falls das gebuchte Arrangement nicht angetreten werden kann, akzeptiert das Gasthaus Edelweiss eine Ersatzperson, welche die bestehende Buchung unter den gleichen Bedingungen übernehmen muss. Die Ersatzperson muss beim Gasthaus Edelweiss frühzeitig (noch vor Anreise) bekannt gegeben werden. Der ursprüngliche Gast bleibt Vertragspartner und haftet gegenüber dem Gasthaus Edelweiss.
If the booked package can not be started, the Gasthaus Edelweiss excepts a substitute replacement, who must accept the existing booking under the same conditions. The substitute person must be announced (before arrival) at Gasthaus Edelweiss early. The original guest stays contractor and is liable to the Gasthaus Edelweiss.
4.4 Annulation bei höherer Gewalt/Annullation at act of nature
Bei höherer Gewalt wie politischen Unruhen, Streiks, Katastrophen u.s.w. kann eine Absage durch das Gasthaus Edelweiss aus Sicherheitsgründen auch kurzfristig erfolgen. In solchen Fällen erhält der Gast den einbezahlten Betrag in Form eines Gutscheines zurück.
Case of force majeure, such as political unrest, strikes, disasters a rejection can be done by the Gasthaus Edelweiss for safety at short notice. In such cases, the guest will be reimbursed in the form of a voucher.
4.5 Störungen und Betreibseinschränkungen
Störungen wie z.B. Lärm und/oder Betriebseinschränkungen berechtigen zu keiner Entschädigung oder Rückerstattung.
Disorders such as Noise and / or operational limitations entitle to any compensation or refund.
5. Schadenersatzpflicht und Haftung/Liability for damages and liability
Das Gasthaus Edelweiss haftet für Schäden nur in den Fällen von Absicht oder grober Fahrlässigkeit. Für eingebrachte Sachen des Gastes wird die Haftung im gesetzlich zulässigen Umfang ausgeschlossen.
Ansprüche müssen umgehend, spätestens 14 Tage nach Abreise, schriftlich beim Gasthaus Edelweiss geltend gemacht werden; anderenfalls gelten die Ansprüche als verwirkt.
The Gasthaus Edelweiss is liable for damages only in cases of intent or gross negligence. The liability is excluded as permitted by law for property brought by the guest. Claims must immediately, not later than 14 days after departure, be made in writing to the Gasthaus Edelweiss asserted; otherwise the claims shall be considered invalid.
6. Benützung der Zimmer/Use of rooms
Das Zimmer ist durch den Gast mit grösster Sorgfalt zu benützen und zu behandeln. Es darf nur durch die Anzahl Personen (einschliesslich Kinder) benützt bzw. belegt werden, welche im Vertrag angegeben ist. Dem Gast ist es nicht gestattet, beim Gasthaus Edelweiss gemietete Hotelzimmer Dritten zum Gebrauch zu überlassen.
Für allfällige Schäden haftet der Gast, ausser er kann nachweisen, dass diese ohne sein Verschulden (bzw. Verschulden von Mitbenützern) entstanden sind. Schäden sind unverzüglich dem Gasthau Edelweiss zu melden.
The room is to be used by the guest with the utmost care and treat. It may only be by the number of persons (including children) used or occupied, which is specified in the contract. The guest is not allowed to entrust the Gasthaus Edelweiss rented hotel rooms for use third parties. For any damage to the guest is liable, unless he can prove that those not at fault (or fault of his authorized users) have emerged. Damage must be reported to the Gasthau Edelweiss immediately.
7. Einschränkungen/limitations
In allen Gebäuden und Zimmer ist das rauchen strikte verboten.
Gäste sind nur tagsüber zwischen 9:00 und 22:00 und nur mit Bewilligung des Gasthaus Edelweiss erlaubt.
In den Räumlichkeiten sind Partys untersagt.
Ab 22:00 Uhr bitten wir die Gäste jeglichen Lärm zu vermeiden und Rücksicht auf die Anderen Gäste zu nehmen.
In all buildings and rooms smoking is strictly forbidden.
Guests are only allowed during the day 9am to 10pm and with the approval of the Gasthaus Edelweiss.
In the premises parties are prohibited.
At 10pm, we ask guests to avoid any noise and to be considerate of the other guests.
8. Crash Pad Vermietung/Crash pad rental
Während der Mietdauer ist der Mieter für die Pads verantwortlich. Für Pads welche gestohlen oder abhanden kommen, sowie zerstört zurück gebracht werden, gelten folgende Konditionen:
Crash Pad klein: CHF 180.-
Crash Pad medium; CHF 250.-
Crash Pad gross: CHF 300.-
During the rental period the tenant is responsible for the pads. For pads who get stolen, got lost or brought back destroyed the following conditions apply:
Crash pad small: CHF 180.-
Crash Pad medium; CHF 250.-
Crash pad big: CHF 300.-
9. Datenschutz/data protection
Das Gasthaus Edelweiss verpflichtet sich, die jeweils anwendbare Datenschutzgesetzgebung bei der Handhabung und Bearbeitung sämtlicher Kundendaten sowie der Kunden-Nutzungsdaten zu beachten. Kundendaten werden lediglich zur Maximierung der Betriebssicherheit oder im Interesse von Verkaufsförderung, Produktdesign, Verbrechensverhütung, Erhebung wirtschaftlicher Eckdaten und Statistiken sowie der Rechnungsstellung verwendet.
Der Gast anerkennt hiermit und stimmt zu, dass das Gasthaus Edelweiss in Fällen einer gemeinsamen Bereitstellung von Leistungen in Zusammenarbeit mit Dritten berechtigt ist, den betreffenden Dritten in dem Umfang
Kundendaten zugänglich zu machen, als dies im Interesse der Erbringung der Leistungen erforderlich ist. Im Übrigen ist die Weitergabe von Kundendaten an Dritte nur mit ausdrücklicher Zustimmung des Kunden gestattet. Eine Ausnahme gilt nur dann, wenn das Gasthaus Edelweiss gesetzlich verpflichtet sind, Personendaten an Dritte weiter zu geben.
The Gasthaus Edelweiss is committed to observe the respective data protection legislation in the handling and processing of all customer data and customer usage data. Customer data will be used only to maximize operational safety and in the interest of sales promotion, product design, crime prevention, economic key data collection and statistics, and billing. Für alle unter diesen AGB mit dem Gasthaus Edelweiss abgeschlossenen Verträge ist ausschließlich schweizerisches Recht anwendbar. Ausschliesslicher Gerichtsstand für allfällige Streitigkeiten aus solchen Verträgen ist Ausserferrera,
For all of these terms and conditions concluded with the Gasthaus Edelweiss contracts exclusively by Swiss law. The exclusive place of jurisdiction for any disputes arising from such contracts is Ausserferrera,
